  1. Agreement to Terms

    These Terms and Conditions ("Terms") constitute a legally binding agreement between you, the user ("you", "your") and George Burgess, trading as Music Linguist ("we", "us", "our"), concerning your access to and use of the https://musiclinguist.co.uk website and its services (the "Service").

    By purchasing access to, and using our Service, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these terms, then you are expressly prohibited from using the Service and must discontinue use immediately.

  2. The Service

    Music Linguist provides a web-based platform that allows users to create, store, and manage notes, answers, lyrics, and other text-based content related to music learning and creation.

  3. Account Creation and Eligibility
    • Eligibility: To purchase and use our Service, you must have the legal capacity to enter into a binding contract. You must be at least 18 years old, or at least 13 years old and have the express permission and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
    • Account Creation: Access to the Service requires a one-time payment. Upon successful payment, you will be prompted to create a user account with an email address and password.
    • Your Responsibilities: You are responsible for all activity that occurs under your account. You agree to keep your password confidential and to notify us immediately of any unauthorised use of your account.
  4. Purchases, Payments, and Refunds
    • Payments: Access to the Service requires a one-time payment. We offer different tiers of access (for example, 30-day access or lifetime access), the prices for which are displayed on our website at the time of purchase. All payments are processed securely by our third-party payment processor, Paddle.
    • No Subscriptions: Our Service is based on one-time payments only. We do not offer recurring subscriptions, and we will not automatically charge your payment method after your initial purchase.
    • Refund Policy: You have a statutory right to a 14-day "cooling-off" period. If you are not satisfied with the Service, you may request a full refund within 14 calendar days of your purchase by contacting us at george@musiclinguist.co.uk. After this 14-day period, all payments are non-refundable.
  5. User-Generated Content (UGC)
    • Your Ownership of Content: You retain full ownership of and all intellectual property rights to the lyrics, notes, and all other content you create and upload to the Service ("User-Generated Content" or "UGC").
    • License You Grant Us: By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, display, copy, and process your UGC. This license is granted for the sole purpose of operating, providing, and improving the Music Linguist service for you. We will not use your private UGC for any other purpose without your explicit permission.
  6. Acceptable Use Policy

    You agree not to use the Service to create, upload, or share any content or engage in any activity that:

    • Is unlawful, fraudulent, or for any illegal purpose.
    • Infringes on any third party's intellectual property rights (e.g., copyright, trademark).
    • Is defamatory, harassing, abusive, threatening, or obscene.
    • Attempts to reverse-engineer, decompile, or otherwise discover the source code of the Service.
    • Contains software viruses, worms, or any other harmful computer code.
    • Involves scraping, data mining, or otherwise gathering data from the Service without our prior written consent.

    We reserve the right to remove any UGC and suspend or terminate any account that violates this policy.

  7. Our Intellectual Property

    The Service itself, including the website design, branding, logos, text, graphics, software, and all underlying source code, are the property of Music Linguist and are protected by copyright and other intellectual property laws. You are granted a limited license only to access and use the Service as per these Terms. You may not copy, modify, distribute, sell, or lease any part of our Service or its intellectual property.

  8. Termination
    • Termination by You: You may terminate this agreement at any time by deleting your account through your account settings.
    • Termination by Us: We may suspend or terminate your account and access to the Service, without prior notice or liability, if you breach these Terms. If we terminate your account for a breach, you will not be entitled to a refund. Upon termination, your right to use the Service will immediately cease.
  9. Disclaimers and Limitation of Liability
    • Service Provided "As Is": The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, that the Service will be uninterrupted, error-free, or completely secure.
    • Limitation of Liability: To the fullest extent permitted by law, in no event will Music Linguist or its owner be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total liability to you for any and all claims arising from your use of the Service is limited to the total amount you have paid to us for the Service.
  10. Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

    Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in England and Wales, and the parties irrevocably consent to the personal jurisdiction and venue therein.

  11. General Provisions
    • Changes to Terms: We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this site. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
    • Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Service.
